(HEREINAFTER THE « SITE »).

PRELIMINARY REMARKS

This contract constitutes a legal agreement between any person browsing or using the Site (hereinafter the “User”) and Karbur – Raw Dog Food & Supplements (hereinafter “Karbur”). In case of disagreement with the terms of this Agreement, the User must immediately stop using the Site.

1. ACCEPTANCE OF TERMS OF USE

By using the Site, the User declares having read, understood and agreed to be bound by these terms of use and any changes that may be made from time to time (hereinafter the “Agreement”). Karbur reserves the right, at its sole discretion and without notice, to update, modify, add or remove any provisions of this Agreement. Any such change will be posted on this page. The User is solely responsible for consulting this Agreement periodically in order to be aware of any changes that may be made to it. By choosing to access the Site, you agree to comply with federal, provincial, and other applicable laws and regulations. The User agrees to abide by all terms and conditions listed herein.

2. YOUR ACCOUNT

By ordering or purchasing dog products offered on the Site, the User may create an account. The User is solely responsible for maintaining the confidentiality and security of their account information and must not disclose this information to anyone. The User is fully responsible for the activities that occur or pass through their account and the User agrees to notify Karbur in the event that the security or confidentiality of their account is compromised. Karbur will not, at any time, be liable for damages and losses arising from unauthorized use by the User of their account. The User agrees to disclose and transmit information that is complete, accurate and truthful when it must disclose or transmit such information using the Site. The User agrees to keep this information up-to-date in the same way. The User agrees that Karbur will be able to use this information in order to keep up to date the billing fees related to the User’s account.

3. INTELLECTUAL PROPERTY

3.1 The trademarks and logos used or displayed on the Site are trademarks and logos registered or not by Karbur or third parties. Nothing on the Site may be interpreted to permit, directly or indirectly, the use of such trademarks or logos without the prior written permission of their owner. Without limiting the generality of the foregoing, it is prohibited to reproduce the trademarks and logos displayed on the Site for commercial or advertising purposes or to increase the volume of visitors to the User’s site.

3.2 All elements of the Site (including, without limitation, texts, articles, photographs, images, illustrations, audio and video extracts, software, etc.) are protected by copyright and belong to Karbur or third parties acting as content providers. Unless clearly stated exceptions, no element of the Site shall be interpreted as granting the User any right whatsoever with respect to the intellectual property of Karbur or a third party acting as a content provider.

3.3 Except as expressly provided in paragraph 3.4 herein, the User may not copy, reproduce, modify, publish, distribute, distribute, participate in the transfer or sale of, create new works from, translate download, sublicense or otherwise exploit any material offered on the Site (including any software), in whole or in part.

3.4 The User may download, publish, or copy for personal use for non-commercial purposes only, the elements of the Site, as long as it retains all intellectual property notices they contain. Copying or memorizing anything for purposes other than personal use is absolutely prohibited without the prior written permission of Karbur or the copyright holder identified in the Intellectual Property Notice.

3.5 The content provided by the User is subject to the license and the rights listed in paragraph 4.3 below.

 

4. DISCUSSION FORUMS AND ELECTRONIC BOARDS

4.1 Communications on message boards and bulletin boards are public and not private. Thus, the User is bound to respect the rules set out below:

4.1.1 Use respectful language. Rude or offensive language will not be tolerated at any time. In addition, no person shall maintain or submit any material that is defamatory, obscene, abusive, pornographic, abusive, or otherwise unlawful;

4.1.2 Be courteous. No one should make threats or incite anyone to violence or hatred. It is also forbidden to deliberately disrupt any discussion by repetitive messages, baseless messages or spamming;

4.1.3 Talk but do not attack. In a group with multiple opinions, people often do not agree. Karbur encourages civilized discussions in its discussion forums; besides, personal attacks are a violation of these terms of use;

4.1.4 No one may use bulletin boards to promote or offer for sale any goods or services for commercial purposes other than those available on the Site or offered by Karbur, conduct or send any study, contest, pyramid scheme or chain of letters, spam (“Spamming”), or for hacking, soliciting or any other act for illegal purposes. It is also forbidden to perform acts that may affect the rights of others and their enjoyment of discussion forums or bulletin boards;

4.1.5 It is forbidden to submit or transmit on our sites, any virus, bug, worm, trojan, or any other code or harmful file.

4.2 The User acknowledges that they have all the necessary rights, including intellectual property rights, on any material they transmit as a user to Karbur.

4.3 The User acknowledges and agrees that they remain the copyright owner of any material they submit as a user to Karbur (for example, letter to the editor, comments, etc.). Furthermore, the User acknowledges and accepts that by the sole act of submitting their material to Karbur, they grant to it a non-exclusive and perpetual worldwide license, without any compensation to the User, to use, edit, modify, delete, reproduce, publish, distribute, and sub-license; for this purpose, they renounce all moral rights they may assert in relation to the integrity of they work.

4.4 The User acknowledges and accepts that they are personally responsible for the content of the messages they communicate on the forums or bulletin boards of the Site, as well as the consequences of these messages.

4.5 Karbur reserves the right, in its sole discretion, not to post or remove any material transmitted by a User for any of its websites, including this Site and the Karbur – Raw Dog Food & Supplements Facebook Page. Moreover, this remains a faculty and not an obligation. Karbur reserves the right to report to the relevant authorities any User who does not respect these rules of conduct and to delete the account of any User who derogates from this Agreement.

4.6 Karbur makes no representation regarding the control of the material available on its website. Karbur is not, and can not be, responsible for the accuracy, legality, compliance with the rules of intellectual property or these terms of use of any material provided by its Users.

5. ADDITIONAL TERMS AND CONDITIONS FOR SUPPLIERS

Additional terms and conditions apply to purchases of dog products that the User selects, including but not limited to, any privacy policy, delivery policy, and agreement governing the use of the website or the services of a provider (hereinafter the “Additional Terms”). The User agrees and agrees to carefully read the Additional Terms and to be bound by them. The User agrees to comply with the Additional Purchase Terms and Conditions imposed by any supplier with whom they choose to do business, including the payment of any amount at maturity, and to comply with the Supplier’s Additional Terms and Conditions with respect to the availability and use of rates, products and services. These hyperlinks are presented for informational purposes only, without guaranteeing their quality or accuracy. The fact that a site is linked to the Site or the Karbur Raw Dog Food & Supplements Facebook page by a hyperlink does not imply an endorsement or a joint venture of any kind.

7. WITNESSES (COOKIES)

A cookie is a small file that requests permission to be placed on the hard disk of the User’s computer. Once the user agrees, the file is added and the cookie is used to analyze the web traffic or allows the user to know when they visit a particular site. Cookies allow web applications to respond to the User as an individual. The web application can adapt its operation to the needs of the user by gathering and memorizing information on their preferences. Overall, cookies help us to provide the User with a Website and products and services of better quality, by allowing us to follow the pages as well as the products and services that the User likes or dislikes. A cookie does not give Karbur any access to the computer or any other information about the User, other than the data they choose to share with us.
The User may choose to accept or refuse cookies. Most web browsers automatically accept cookies, but the user can generally modify the settings of his browser to refuse cookies if they prefer but this will prevent the user to take full advantage of the site.

8. LIMITATION OF LIABILITY

This Site, including the content it offers is made available to you “as is” without any warranty, whether express or implied. The information, software, products, and services published on this Site may contain inaccuracies or errors, including price errors. In particular, Karbur and its affiliates do not guarantee the accuracy and accept no liability for errors or inaccuracies in the information and description of the products offered or posted on the Site. In addition, Karbur expressly reserves the right to correct any pricing errors on the Site and / or purchases or orders in progress made at an incorrect price.

Without limiting the generality of the foregoing, in no event will Karbur, its affiliates and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way related to, Access the posting of the User or the use of this Site, whether this liability is based on negligence, a contract, an offense, an extracontractual obligation, a strict obligation or otherwise, and this, even if Karbur, its subsidiaries and/or their respective suppliers have been advised of the possibility of such damages.

9. COMPENSATION

The User hereby agrees to defend and hold harmless Karbur, its directors, officers, officers, shareholders, employees, affiliated companies, representatives and content providers (for the purposes of this Article 9 hereinafter referred to collectively as “Karbur”) of any monetary, interest, legal, and non-judicial charge and other damages including, but not limited to, all reasonable legal costs incurred by Karbur in connection with any claim, suit, action or demand (hereinafter “Claim”) arising from:

i) any content submitted, posted or transmitted by the User on the Site;
ii) the use by the User or a person using the User’s account, whether or not the User has been authorized, the Site, your connection to it or any other breach of this Agreement;
iii) any violation of the laws and regulations in force or the rights of a third party.

10. NEWSLETTER OR OTHER COMMUNICATIONS

By accepting this Agreement, the User agrees to be part of the mailing list set up by Karbur and authorizes Karbur to provide them with all the information regarding the use of the Site, the dog products offered on the Site, the novelties and special offers on the Site, new surveys and other information deemed relevant by Karbur. At any time the User may unsubscribe from the mailing list by contacting us at the following email address  info@karburnation.ca and indicating that they no longer wish to receive such communications. Such unsubscription does not prevent the User from being bound by this Agreement.

11. APPLICABLE RIGHT

By using this Site, including any order or purchase on the Site, the User acknowledges and agrees that this Agreement and any Claim, suit, action or notice arising from the use of the Site, including any order or purchase, governed by the laws applicable in the province of Quebec and by the federal laws applicable in Canada. The User hereby irrevocably acknowledges and submits to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Terrebonne, with respect to all disputes arising from this Agreement and its use of the Site.

12.SHIPPING POLICY

WHAT ARE THE COSTS OF DELIVERY?

Delivery rates are calculated at the end of the order according to the place of delivery and timelines.

WHAT ARE THE DELIVERY TIMELINES?

Your order will leave our warehouse the same day or the day after your order (days on weekdays). Subsequently, there is a delay of 1 to 3 working days for delivery anywhere in Quebec and Ontario, depending on your sector. For delivery to national destination (rest of Canada), deadlines are from 5 to 7 working days. For orders in the United States, deadlines are 10 working days.

Please note that there may be a slightly longer delivery time in high periods such as sales (Black Friday, Boxing Day) as well as during the holiday season. Due to the various strikes / pressure tactics carried out by postal services, deadlines can also be extended.

IS IT POSSIBLE TO PICK-UP MY ORDER RATHER THAN HAVING IT DELIVERED?

Yes, it’s possible. Particularly with respect to the purchase of meats and organs, delivery can be arranged at a local level, within a 30-km radius. For greater distances, you must schedule an appointment to establish a meeting point and collect your order or check out with one of our retailers.

I CLICK ON MY TRACKING NUMBER AND MY PACKAGE SEEMS TO HAVE GONE ASTRAY. WHAT CAN I DO?

You can contact the Canada Post team directly (1-866-607-6301) with your tracking number on hand. They are the ones who will tell you exactly where your package is. If they can’t seem to find it (which is rare), write us at info@karburnation.ca,we will take care of the rest with you.

ARE THE DELIVERY FEES REFUNDABLE?

All the delivery fees, including costs for returning, are not refundable.
